Terms and Conditions

1.0 Introduction

These Terms and Conditions (“Agreement”) govern your use of the services provided by JOYHOMES TOURS & TRAVEL SDN. BHD. (“the Company”). By accessing or using our services, booking a tour, or making any transaction with us, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

2.0 Booking and Payment

  • Reservation and Deposit: A deposit of 25% of the total tour fare is required upon booking to secure your reservation.
  • Full Payment: The balance must be paid no later than 60 days before the departure date. Failure to do so may result in cancellation of your booking and forfeiture of the deposit.
  • Prices: All prices are quoted in Malaysian Ringgit (MYR) unless otherwise stated. The Company reserves the right to adjust prices due to currency fluctuations, fuel surcharges, or changes in airline/government taxes.

3.0 Cancellation and Refund Policy

  • Cancellation of reservation must be made in writing to avoid any misunderstanding. If the company receives notice to cancel 30 days or more before the date of departure, a minimum administrative fee of RM50.00 or 10% of the tour deposit (whichever is lower) per person will be levied.
  • If notice of the cancellation is received 29 days or less before the date of departure the following charges will apply:-

  • The respective airline’s cancellation policy on special promotional fare shall apply in addition to the cancellation charges as set out in clause above (Note: The airline ticket is restricted and subject to the Airline’s Terms and Conditions. It may be non-endorsable, non-reissue able, and non-refundable and no reroute able. Any alteration in routing or change of date of travel by any passenger is solely at his own risk. The company or its associated agents shall not be held responsible for any inconvenience caused and extra expenses incurred. However, any refund made by any airline for a cancellation made 2 working days or less before the day of travel for non-promotional fares shall be paid to the tour member less any administration charges incurred by the tour company).

All refunds (if applicable) will be processed within 30 working days. The Company will not be responsible for any additional bank or processing charges.

  • Cancellation of booking must be made in writing to avoid any misunderstanding. If the company receives notice to cancel 45 working days or more before the date of departure, a minimum administrative fee of RM30.00 per person or 2% of the tour fare (whichever is higher) per person will be levied.
  • If notice of the cancellation is received 44 working days or less before the date of departure the following charges will apply:

  • The respective airline’s cancellation policy on special promotional fare shall apply in addition to the cancellation charges as set out in clause above (Note: The airline ticket is restricted and subject to the Airline’s Terms and Conditions. It may be non-endurable, non-reissue able, non-refundable and non-reroute able. Any alteration in routing or change of date of travel by any passenger is solely at his own risk. The company or its associated agents shall not be held responsible for any inconvenience caused and extra expenses incurred).
  • The company reserves the right to cancel the four due to any act of god, war, strike, riot or order from the Government of Malaysia which is beyond its control.
  • The company shall recommend alternative tours preferably to the same destination or other tours. Should any passenger decide not to accept the alternative tours, all moneys paid less the administrative fee chargeable will be refunded to the passenger.
  • The company reserves the right to cancel the four due to any act of God, war, strike, riot or order from the Government of Malaysia which is beyond its control.
  • The company shall recommend alternative tours preferably to the same destination or other tours. Should any passenger decide not to accept the alternative tours, all moneys paid less the administrative fee chargeable will be refunded to the passenger.
  • In the event of a cancellation by the company due to insufficient passengers or inability to secure seats or accommodation, the company will refund the amount of money paid and also pay compensation as follows: Cancellation Received Cancellation Charges Per Person

4.0 Travel Insurance

Tour Members are strongly advised to purchase comprehensive travel insurance to cover personal accidents, medical expenses, trip cancellations, baggage loss, and other unforeseen circumstances. The Company shall not be responsible for any losses or damages resulting from the lack of travel insurance.

5.0 Liability and Responsibilities

  • The Company acts as a travel agent and does not own or control airlines, hotels, transport companies, or other suppliers. Therefore, the Company is not liable for any injury, damage, loss, delay, or irregularity caused by third-party service providers.
  • Tour members agree that the Company shall not be responsible for any accidents, injuries, sickness, death, or loss of personal belongings during the trip.
  • The Company reserves the right to make changes to tour itineraries, accommodation, and transportation due to unforeseen circumstances.

6.0 Travel Documentation & Requirements

  • Tour members are responsible for ensuring they have a valid passport (minimum 6 months validity from the date of return), necessary visas, and other travel documents required by the destination country.
  • The Company is not responsible for any rejection of entry or deportation due to incomplete or incorrect travel documentation.
  • Service charges and visa fees levied shall be borne entirely by the customer.

7.0 Force Majeure

Tour members with special needs (e.g., dietary restrictions, mobility assistance) must inform the Company at the time of booking. While the Company will endeavor to accommodate such requests, it cannot guarantee that all requests will be fulfilled.

8.0 Tour Members Responsibilities

  • Behavior & Conduct: Tour members are expected to behave in a manner that does not disturb other travelers. The Company reserves the right to remove any Tour Members who engages in inappropriate behavior.
  • Health & Medical Conditions: Customers are responsible for ensuring they are medically and physically fit to travel. Any pre-existing medical conditions must be disclosed at the time of booking.

9.0 Indemnity

Tour members agree to indemnify and hold harmless JOYHOMES TOURS & TRAVEL SDN. BHD., its affiliates, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

  • Any negligence or misconduct during the trip.
  • Their use of the Company’s services.
  • Violation of these Terms and Conditions.

10.0 Links to Third Parties

Our website and promotional materials may contain links to third-party websites (e.g., airline booking sites, hotel portals). The Company does not control or assume responsibility for the content, privacy policies, or practices of these third-party websites.

11.0 Severability

If any provision in this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12.0 Relationship Between the Parties

Nothing in this Agreement shall be construed to create a joint venture, partnership, employment, or agency relationship between you and the Company.

13.0 Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in Malaysia.
